USCIS Announces H-1B Policy - New Rule for F and J Visa Holders The USCIS has announced that the cap of 115,000 new H-1B cases for the fiscal year 1998-1999 will soon be reached. They are process for immediate employment, only cases filed by April 9, 1999. That cutoff date may change depending on how many of those cases are approved. Cases that the USCIS received on or after June 15, 1999 will be processed for an October 1, 1999 start date. The USCIS will return petitions received on or after June 15, 1999. Those petitions may be refiled on or after October 1, 1999. F and J visa holders who filed timely applications for change of status to H-1B temporary worker may remain in the United States while waiting to begin work as H-1B workers on October 1, 1999. However, unless you have employment authorization, you may not work until the new H-1B visas become available in October.
