We missed the January 2000 update due to a change in our server. You didn't miss much since Congress was out and USCIS wasn't very active.

    Regarding eligibility for permanent residence under NACARA, at the third dot, the line should read "A Guatemalan national who entered the United States by October 1, 1990 and who applied for ABC benefits on or before December 31, 1991."

    Regarding the unlawful status bar to permanent residence, the U.S. State Department has determined that for the purpose of the three and ten year bards to permanent resident., a Canadian or Commonwealth citizen residing in Canada who entered the United states with inspection but was not issued an I-94 will not be considered to have accrued unlawful presence unless and until a violation is found by an immigration judge or USCIS officer. This is same rule that applies to nonimmigrants granted D/S or duration of status at entry.

H1-B Update
    It now appears the USCIS won't reach the cap for this years H-1B allocation until sometime in March. However, I recommend that you file your application as soon as possible. The cap applies to all new applications but not to extensions of stay by current H-1B status holders.
